By accessing or purchasing from Carrier Data USA ("Company," "we," "us"), you agree to be bound by these Terms of Service. Please read them carefully before making a purchase.

1. Description of Service

Carrier Data USA provides downloadable CSV files containing motor carrier contact data sourced from the publicly available FMCSA DOT Census — a federal government database. We offer various list sizes and configurations for one-time purchase prices with no ongoing subscription.

2. Purchases and Payment

All purchases are processed securely through Stripe. Prices are listed in USD. All sales are final. By completing a purchase, you authorize us to charge the applicable fee to your selected payment method.

Upon successful payment, you will receive an email with a download link for your purchased CSV file. Delivery is instant and automated.

3. Refund Policy

Due to the digital and instantly deliverable nature of our products, all sales are final. We do not offer refunds after a download link has been delivered. If you experience a technical issue preventing access to your file, contact us at support@carrierdatausa.com and we will resolve it promptly.

4. License and Permitted Use

Upon purchase, we grant you a non-exclusive, non-transferable license to use the purchased data for your own B2B marketing and business outreach purposes. You may:

• Import the data into your CRM, email platform, or marketing tool
• Use the data for direct outreach to trucking companies and motor carriers
• Use the data in your own internal business operations

You may not:

• Resell, redistribute, sublicense, or share the data with third parties as a data product
• Use the data in ways that violate CAN-SPAM, TCPA, or other applicable laws
• Use the data for spam, harassment, or any illegal purpose

5. Data Source and Accuracy

All data is sourced from the FMCSA DOT Census, a public federal government dataset. While we take care to provide clean, filtered data, we make no warranties regarding the completeness, accuracy, or fitness for a particular purpose of the data. The FMCSA database is updated periodically; some contact details may change over time.

6. Compliance with Laws

You are solely responsible for ensuring your use of the data complies with all applicable laws, including CAN-SPAM, the Telephone Consumer Protection Act (TCPA), and any other federal, state, or local regulations governing marketing communications.

7. Limitation of Liability

To the maximum extent permitted by law, Carrier Data USA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our data or services. Our total liability shall not exceed the amount you paid for your purchase.

8. Intellectual Property

The FMCSA data is sourced from a public government database. Our website design, copy, and branding are the property of Carrier Data USA and may not be reproduced without permission.

9. Modifications to Terms

We reserve the right to update these Terms of Service at any time. Continued use of our website after changes constitutes acceptance of the updated terms.

10. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration.
